Update: Man Still Trying to Get Dog Back

CBS 21 News has continuing coverage of a story we first told you about back in August. On Wednesday, CBS 21 News learned that an agreement that the Harrisburg Humane Society made with a once homeless man to get his dog back is falling apart.

In July, a Humane Society officer took Miles Thomas' dog Baron, from his car, while Miles at lunch nearby. After that happened, Stephen Conklin let Miles move in with him and agreed to let Baron live there as well. Part of the agreement made three weeks ago, says Conklin would share custody of the dog with Miles. Stephen Conklin Spoke exclusively with CBS 21 News and says he disagrees with certain parts of the foster care agreement.

" You know, they're going to foster the dog and all these agreements and contingencies, that go with it, coming in and inspecting me, do I have a fit place? I see a different agenda running there," said Stephen Conklin, lives with Miles Thomas.

Here is part of a statement released from the Harrisburg Area Humane Society:

" During each of the two trial days, the judge has given the parties guidance on a resolution of the case. Each time, HSHA has worked diligently to come to come to an amicable resolution that is in the best interest of all parties involved. We are hopeful that Mr. Thomas' attorney will continue to work with HSHA towards finalizing the foster agreement. A foster agreement would truly benefit Mr. Thomas and Baron and is commonly used to provide a Humane Society resident with a temporary home outside of the shelter. While the resident is temporarily placed via the foster agreement, the Humane Society would still provide veterinary care, food, and supplies for the resident and remains responsible for the overall care and welfare of the resident. "

The Humane Society still has Baron in its custody. If an agreement isn't reached, this case may be headed back to federal court for a third time.
